General standard terms and conditions

1 Operator of BKW promotion shop and validity of these general standard terms and conditions of business

The BKW promotion shop is operated by Adcom Switzerland AG (Ruessenstrasse 5, CH-6340 Baar, Switzerland). Adcom Switzerland AG is registered with the Local Court of Zug (commercial register: CH-170.3.023.846-2). Managing Director is Ms Andrea Schilter. These general standard terms and conditions shall apply exclusively on the sale of goods by Adcom Switzerland AG. Other terms and conditions of business shall only apply if previously accepted by us.

Adcom Switzerland AG reserves the right to change the present general standard terms and conditions at any time. The binding version is the version valid and available at time of purchase. Terms or general conditions of the client or a third party opposing these GTC are not valid. The GTC shall apply exclusively even if Adcom Switzerland AG unreservedly carry out delivery with knowledge of a customer’s conflicting or deviating terms or general conditions. 

2 Offer / contract conclusion

The offer, that is all specifications regarding products and prices in the online shop, is directed solely to clients based in Switzerland. Adcom Switzerland AG explicitly reserves the right to change the offer, including change of selection and prices, at any time.

Through the presentation of our products you are requested to submit a purchase offer in form of an order. By clicking on the button “place order” (“Bestellung aufgeben”) during the final step of the order process, you are placing a binding order for the items contained in the shopping cart. As soon as we receive your order, you will receive an automatic email with the confirmation of your order.

Prices in the online shop are in Swiss Francs (CHF) and include the statutory VAT of 7.7%.

Minimum age for purchases in the online shop is 18 years.

3 Acceptance of an order

The product display in the online shop does not constitute a legally binding offer, but rather an invitation to place an order. A legally binding order only takes place if you have entered all details required for the completion of a contract, confirmed the acknowledgment of our terms and conditions for business and clicked on “place order”. You can change your order and details in regards to your order at any time before clicking “place order”.

We reserve the right to accept an order. The decision hereon is at the sole discretion of Adcom Switzerland Ag. In case a delivery is not carried out, you will be notified via email immediately.
Please note that the online sale of our products is only possible in Switzerland.   

4 Shipping and shipping charges

Ordered items will be delivered to the address stated by the customer. The ordered goods can only be shipped to one address. The shipment of the goods is at the customer’s own expense and risk; also in case of partial delivery. Outwardly visible damages on the ordered items will be compensated on presentation of a certificate of the respective carrier. Shipping charges for orders carried out in partial deliveries are only charged once. In case one or several ordered items are already sold out at the time of your purchase, we cannot accept your order. You will be notified via email immediately.

Parcels are shipped with Swiss Post. Shipping within Switzerland is free of charge.

5 Payment conditions

All prices are in Swiss Francs and include the respective statutory sales tax.

Payment is made by credit card (Visa, MasterCard, PostFinance Card).

Please note that additional costs for transfers, account management, etc. can occur, based on your agreements with credit institutes or other institutes.

We reserve the right to reduce the use of the above mentioned types of payment to one or several types of payment.

6 Reservation of ownership

The delivered products remain the property of Adcom Switzerland AG until the purchase price has been paid in full by the customer.

7 Right of return

The customer does not have a fundamental right of return. Wrongly ordered items can only be sent back with the consultation and consent of Adcom Switzerland AG. Complaints and replacements can only be accepted within 5 days after delivery. Such revocation shall be effected in writing or by return of the goods. Always enclose with your return a copy of the order documents. Items, which have been made according to client specifications or were clearly adapted to the personal requirements of the client, cannot be returned.

8 Returns with Swiss Post

Please note:

-       Articles have to be in original packaging

-       Parcels which are not franked will not be accepted by Adcom Switzerland AG and will be sent back and charged to the sender

-       A punctual dispatch is sufficient for compliance with the time limit

-       A return is at the client’s expense and risk

Payments will be transferred back to the concerned card in full.

9 Warranty

Your legal warranty period is 2 years upon receipt of the goods. We will remedy any defects covered by the statutory warranty obligation during this period. You may request either that the defect be remedied or that a defect-free product be supplied, whereby your choice may be limited by the statutory requirements. In case the remedy of defects fails, you can choose between either a claim of rescission from the contract or a reduction of the purchase price. Otherwise, the statutory right to claim compensation, including compensation of the damage as well as the futile expenditures applies.

10 Exclusion of liability

Adcom Switzerland AG rejects liability for all direct (or immediate) and indirect damages resulting from the use of the online shop or from ordering goods or concluding contracts through the online shop to the extent permitted by law. Adcom Switzerland AG rejects liability in particular for minor or medium negligence. Adcom Switzerland AG also does not incur contractual or extracontractual liability for damages, which were caused by any person asked for assistance.

11 Place of jurisdiction and applicable law

The legal relationship is subject to the Swiss law. The place of jurisdiction is the registered office of Adcom Switzerland AG in Zug, Switzerland.
